1. Defective Fireworks / Store Credit
Store credit may be issued for fireworks that do not fire correctly. Clear photographic proof is required. All determinations are made at the sole discretion of Big Bang Fireworks. No cash refunds will be issued.

2. Order Fulfillment & Substitutions
Every reasonable effort will be made to fulfill customer orders exactly as placed. If a product is unavailable, Big Bang Fireworks reserves the right to substitute a product of similar or greater value, within the same firework class, and as close to the original model as possible.
If no comparable item is available, the unavailable product will be removed from the order and automatically deducted from the total bill.

3. Order Cancellations & Returns
All fireworks sales are final. Orders may not be canceled or returned once processing has begun. Fireworks are non-returnable due to their hazardous nature, except as expressly provided under the 100% No Dud Guarantee.

4. Pricing & Typographical Errors
Big Bang Fireworks reserves the right to cancel or refuse any order placed due to typographical errors, incorrect pricing, inventory errors, or system errors, even after an order confirmation has been issued.

5. Right to Refuse Service
Big Bang Fireworks reserves the right to refuse service, cancel orders, or terminate accounts at its sole discretion, including but not limited to suspected fraud, abuse of policies, chargeback activity, or violation of these Terms and Conditions.

6. State & Local Fireworks Laws (Customer Responsibility)
It is the customer’s responsibility to know and comply with all applicable state, county, and local fireworks laws. Laws vary by jurisdiction and may change without notice.
If fireworks are prohibited or restricted in your location, do not place an order.

7. Online Shipping Restrictions (State Eligibility)
Big Bang Fireworks ships consumer fireworks only to states where “All Consumer Fireworks” are permitted under state law.
Online fireworks sales and shipping are NOT allowed to the following states and district:
Arizona, California, Colorado, Connecticut, Delaware, Hawaii, Idaho, Illinois, Maryland, Massachusetts, Minnesota, Montana, Nevada, New Jersey, New York, North Carolina, Oregon, Rhode Island, Vermont, Virginia, Wisconsin, and Washington, D.C.
Orders placed with delivery addresses in any restricted state or district listed above may be canceled at the sole discretion of Big Bang Fireworks, even if the order is successfully placed.

8. Inspection Upon Receipt / Shipping Damage
All fireworks must be inspected immediately upon receipt. If damage occurred during shipping:
• Take clear photographs immediately
• Notify the delivery driver at the time of delivery
• Follow the shipping carrier’s damaged-goods procedures
• Contact Big Bang Fireworks promptly
Failure to follow these steps may void any damage claim.

9. Processing & Shipping Timeframes
Orders are processed within one (1) week. Shipping times vary by carrier and destination and must be added to processing time when estimating arrival.

10. Seasonal Shipping Cutoffs
To prevent late-season disappointment, Big Bang Fireworks enforces the following shipping cutoffs:
• July 4th Season: No shipping after June 15
• New Year’s Season: No shipping after December 15
Orders placed after these dates may not arrive in time for the intended season.

11. Membership Auto-Renewal
All Big Bang Fireworks memberships are enrolled in automatic annual renewal. To cancel a membership, customers must provide at least 30 days’ notice prior to the renewal charge date. Failure to cancel within this timeframe will result in automatic renewal.

12. Age Requirement
By purchasing fireworks from Big Bang Fireworks, the customer certifies that they are at least 18 years of age, or the minimum legal age required in their jurisdiction.

13. Payment Disputes & Chargebacks
Customers agree to contact Big Bang Fireworks directly to attempt resolution of any order issue prior to initiating a chargeback or payment dispute. Abuse of chargebacks may result in account termination.

14. Product Use & Safety
Customers must carefully read and follow all instructions and warnings printed on each firework label. Fireworks must be used exactly as directed. Do not alter, modify, or deviate from manufacturer instructions.

15. Assumption of Risk & Hold Harmless Agreement
By purchasing fireworks from Big Bang Fireworks, the customer assumes all risks associated with fireworks use and agrees to hold Big Bang Fireworks harmless from any and all claims, damages, losses, injuries, or liabilities arising from the purchase, possession, transportation, or use of fireworks.

16. Limitation of Liability
In no event shall Big Bang Fireworks’ total liability exceed the total purchase price paid by the customer for the order giving rise to the claim.

17. Force Majeure
Big Bang Fireworks shall not be held liable for delays or failure to perform due to events beyond its reasonable control, including but not limited to weather events, natural disasters, port congestion, labor disputes, carrier delays, governmental actions, tariffs, or supply chain disruptions.

18. Governing Law & Exclusive Venue (Jurisdiction)
These Terms and Conditions, and any dispute, claim, or legal action arising out of or relating to the purchase, possession, shipment, or use of fireworks from Big Bang Fireworks, shall be governed by and construed in accordance with the laws of the State of Florida, without regard to conflict-of-law principles.
The customer expressly agrees that exclusive jurisdiction and venue for any legal action or proceeding shall be in the state or federal courts located in Lake County, Florida, and the customer knowingly and voluntarily submits to the personal jurisdiction of such courts.
The customer waives any objection to venue based on inconvenience or forum non conveniens.

Membership benefits may include discounts, signup bonuses, and other promotional benefits offered from time to time. Benefits are subject to change, modification, or removal at the sole discretion of Big Bang Fireworks.

21. Rewards Abuse & Limitations
Big Bang Fireworks reserves the right to withhold, revoke, or adjust cashback rewards or store credit in cases of suspected abuse, fraud, excessive returns, chargebacks, or violation of membership terms.

Shipping dates are estimates only. Big Bang Fireworks is not responsible for carrier delays, weather disruptions, or logistical issues beyond its control. Delivery delays do not qualify for refunds, cancellations, or compensation.
